Terms of Sale
These terms govern the sale of Bizleen's paid subscriptions. They complete the Terms of Use, which govern the use of the service. By taking out a subscription, you accept both. The French version is the legal reference.
1. The seller
Bizleen is a service operated by Dan Nutu EI, which publishes and sells it, at 137 Rue des Landes, 78400 Chatou, France. Its full identity, registration number and contact details are set out in the legal notice, which French law requires to be published in French. For anything else, write to contact@bizleen.com.
2. Who the paid plans are for
The Presence and Business subscriptions are reserved for professionals: a company, an association, a self-employed person, a craftsman, a professional practice, or anyone subscribing in the course of a business activity. You do not need to have set up a company, but the subscription must serve an activity, not private use.
The Card plan, which is free, stays open to everyone.
We nevertheless grant all our customers, whatever their status, the fourteen day right of withdrawal set out in article 7. It is a commercial choice, not an obligation: we would rather refund someone who has changed their mind than argue about their status.
3. The plans and what they contain
Three plans coexist. The current feature breakdown is shown on the home page; what follows sets out the contractual commitments attached to them.
Card, free
A digital business card at a bizleen.com/@your-handle address,
with a QR code, a downloadable contact file, themes, a logo, an accent
colour and two languages. Also included, at no extra cost: the
detailed statistics of your page, the QR code generator and the email
signature generator.
The counterpart of it being free is the Bizleen mark, and nothing else. The Bizleen signature stays visible on the public page, and the QR codes and email signatures produced under this plan carry the Bizleen mark. Statistics carry none: they are open with no counterpart.
Presence
Everything the Card plan contains, with the Bizleen mark removed everywhere it appears, plus the full venue page: address, map, opening hours, category, action buttons, structured menu or price list, photo gallery, about section, services, testimonials, frequently asked questions, one-off events, recurring nights and appointments that you schedule yourself, dish of the day, PDF document, contact form, Google rating refreshed twice a year, importing a menu from a photograph and editing delegated to an employee. All of it in three languages, managed by you.
Presence is a self-service plan: Bizleen supplies the tool, you enter and update your content yourself.
Business
Everything the Presence plan contains, plus a service performed by Bizleen: setting up your page from the documents you send us, writing the descriptions, translations into up to five languages, matching your photographs to dishes, products or services, keeping your calendar, recurring nights and appointments included, a refresh of the Google rating every month, working your content for search engines, handling routine updates within reasonable limits, two major changes a year (a new menu, a new catalogue or a substantial rework of your services), and support by email and WhatsApp.
Bizleen neither takes nor supplies any photograph. The photographs are supplied by you; we integrate them and match them to the right content.
We commit to acting within forty-eight hours of receiving your material, save in a case of force majeure. That deadline only starts running once you have sent us what is needed: we do not go hunting for documents, and a request with nothing attached does not start the clock.
Search engine visibility is a best-efforts obligation: we prepare and structure your content for search engines. No position, no ranking and no volume of visits are guaranteed.
Team member cards, included in both paid plans
The Presence plan includes up to twenty team member cards, the Business plan up to twenty, on top of the card of your own venue. What separates the two plans is the work Bizleen takes on, never a number of cards.
Each of those cards carries the visual identity of your venue, has its own public address and its own QR code, and can be handed to the team member concerned: they keep what belongs to them up to date, their contact details, their photograph and their own introduction, while you keep control of the professional identity, including the name of the venue and the job title.
Beyond that number, write to us: we will quote for it. When your subscription ends, those cards are detached from your venue, under the conditions set out in article 9.
4. Prices
Prices are shown in euros and net of tax. Dan Nutu EI falls under the French VAT exemption for small businesses, and the law requires the French wording to be used as it stands: TVA non applicable, article 293 B du CGI. It means that no VAT is charged: none is added to the amount shown, so the price you see is the price you pay.
- Card: free.
- Presence: €50 per year, or €5 per month.
- Business: €200 per year, or €20 per month.
On every paid plan, the yearly option works out at two months free compared with twelve monthly payments.
Prices may change. A change never applies to a running subscription: it takes effect at the next renewal, and you are told by email at least thirty days beforehand.
5. Subscribing and payment
You subscribe online from your Billing area. Before you confirm, a summary shows you the plan, the billing period and the amount. Confirming places an order with an obligation to pay.
Payments are handled by Stripe. Bizleen neither receives nor stores any card number. Payment is taken when you subscribe, then at each renewal.
6. Term, renewal and cancellation
The subscription is entered into for the period you choose, monthly or yearly, and renews by tacit agreement for an identical period unless you cancel.
You can cancel at any time, without giving a reason and without penalty, from your Billing area. Cancellation takes effect at the end of the current period: you keep access to what you have paid for until it runs out, and nothing is owed for the following period. Amounts already paid for the current period are not refunded, except where you exercise the right of withdrawal set out in article 7.
For a yearly subscription, you are told by email of the renewal date and of the option not to renew, at the latest one month before the cancellation deadline.
On cancellation, your page moves to the free Card plan. It is neither deleted nor unpublished as a result of the cancellation. The capabilities specific to the paid plans stop, and the team member cards are detached from your venue, under the conditions of article 9.
Deleting your account is a different act from cancelling, and it does not replace it: while a subscription is running, deleting the account is refused. You cancel first, then your account becomes deletable. We made that choice so that deleting an account never silently triggers a commercial decision. Deletion then carries the erasure described in the Privacy policy.
7. Right of withdrawal
You have fourteen days from subscribing to withdraw, without having to give a reason and without penalty. That period is granted to you whether you are a consumer or a professional: we chose not to make this right depend on your status.
To exercise it, just write to us at contact@bizleen.com, the address shown in the legal notice, giving your name and the address of your card. No particular form is required. The refund is made within fourteen days of your request reaching us, by the same means of payment.
If you ask for the service to start straight away
The features of a subscription switch on immediately after payment, and the setup of a Business plan starts as soon as your documents reach us. By subscribing, you expressly request that performance begin before the fourteen day period is over.
If you withdraw once the service has already started, you still owe the amount corresponding to what has been supplied to you up to your request, calculated pro rata. For a Business plan whose setup has been carried out, that amount takes account of the work actually done, on a detailed statement.
8. Commercial reference
We put real work into preparing a Business page. You authorise us, including after your subscription ends or if you withdraw, to keep the page produced and to show it as a reference to people interested in the service.
This authorisation is strictly bounded:
- the page is not published: it is reachable only through a private link carrying a token, and it is indexed by no search engine;
- it is shown only to demonstrate what Bizleen can do, never exploited commercially for anything else;
- it is no longer updated and does not claim to reflect your current activity;
- you can object at any time, by a simple written request and without having to give a reason. We then take the page out of our references.
9. What happens when a plan ends
This article sets out precisely what becomes of your content. We have written it in detail because a customer has the right to know what they lose, what they keep, and what they can get back.
What is yours and never moves
The content you have entered, the photographs you have supplied, your contact details, your prices, your opening hours: they stay yours, they stay in place, and they stay editable by you. Changing plan does not touch them.
What belongs to the Business service
Some content is produced by Bizleen under the Business plan: the descriptions we write, the translations we produce, the matching of your photographs to each dish, product or service. We remain the holders of it, and you have the benefit of it for the term of your Business subscription.
Your photographs remain yours in every case. What belongs to our service is their matching to a specific item, never the photograph itself.
Some capabilities belong to this plan too: languages beyond three, Bizleen keeping your calendar, a refresh of the Google rating every month instead of twice a year, and the handling of updates. Creating recurring nights and appointments does not belong to it: that is part of the Presence plan too, and you keep it.
Moving from Business to Presence
If you leave the Business plan, the capabilities above stop, and what becomes of the content produced by Bizleen depends on what you have paid:
- Before four monthly payments have actually been collected, on a monthly plan: the content produced by Bizleen is suspended. It disappears from your public page and from your editor.
- From four monthly payments actually collected onwards, or on a yearly subscription: the descriptions and translations already published stay in place. The work is treated as paid off. Only the capabilities listed above stop.
The count is on the paid periods actually collected, that is on the invoices actually settled, and not on the time elapsed. A month left unpaid does not count.
Team member cards, when a paid subscription ends
When a paid subscription ends, for whatever reason, the team member cards are detached from your venue. We write down here, point by point, what that word covers: those cards are printed on QR codes and sit in email signatures, and nobody should find out afterwards what becomes of them.
- They stay online. Detaching deletes no card, unpublishes none and erases no content: each one answers at the same public address, with the same information.
- They become free cards again, governed by the Card plan: the Bizleen signature comes back on their public page, the Bizleen mark comes back on the QR codes and email signatures they produce afterwards, and the capabilities reserved for the paid plans stop, as on any free card.
- They stop carrying the visual identity of your venue. The logo, theme and colour imposed on the team no longer apply, and each card gets its own back.
- The team member keeps access to their card. That access is not withdrawn, and it stops being limited to personal fields: the team member can now edit every field the free plan allows, including the ones your venue kept for itself. That follows directly from detaching, and we would rather write it down.
- Nothing reattaches on its own. If you take a paid subscription again, your team settings are found exactly as you left them, but reattaching the cards is a step you take again from your own area.
Four guarantees, in both cases
- Nothing is destroyed. Suspended content is kept, not deleted. No automatic mechanism erases your content, however old it is.
- Everything can be restored. If you take the Business plan again, we put the suspended content back at no extra cost and without having to redo the work.
- You can write your own. Wherever a description produced by Bizleen is suspended, the field is handed back to you, free for you to fill. What you write in it is yours and is never overwritten automatically, including if you take the Business plan again later.
- You are told. A change of plan is confirmed to you in writing, with a reminder of what has been suspended.
10. Your obligations
You warrant that you hold the rights to everything you send us, in particular the photographs, and that this content infringes no third-party right. You are responsible for the accuracy of the information published, in particular prices, opening hours and allergens.
For the Business plan, the quality of the result depends on the quality of the documents you send us. We guess nothing: information that is absent from your documents is not invented.
11. Failed payment
If a payment fails, your access is kept for as long as our payment provider retries it automatically. If nothing has been settled by the end of that period, the subscription is cancelled and your page moves to the free Card plan, under the conditions of article 9. Between professionals, the late payment penalties and the fixed recovery indemnity provided for by law apply.
12. Liability
We are held to a best-efforts obligation, not an obligation to achieve a result, on the availability of the service as well as on search engine visibility. No position in search engines, no volume of visits and no commercial result are guaranteed.
Bizleen does not answer for indirect losses: loss of customers, loss of revenue, loss of opportunity, lost profit, damage to reputation or commercial loss. The service is a way of presenting your business; it replaces neither your activity nor your other channels.
In any event, our liability is capped at the amounts you have actually paid us over the twelve months preceding the event giving rise to it. For a free account, that cap is nil.
This limitation does not apply in the case of gross negligence or wilful misconduct, nor in the cases where the law forbids limiting liability. We write it down so that you know exactly how far it goes.
13. Warranties
You have the benefit of the statutory warranties provided for by law, in particular the warranty of conformity and the warranty against hidden defects where you are entitled to them. Nothing in these terms sets them aside.
We commit to a best-efforts obligation on the availability of the service. Bizleen is not liable for interruptions caused by an outside event, in particular a failure of the host, of the network, or of a third-party service.
14. Complaints
Any complaint must be sent to us first, by email, at the address shown in the legal notice: contact@bizleen.com. We commit to answering within five working days.
Our policy is simple and we would rather write it down than let you guess it: if we disagree, we refund. The service is not worth a dispute, and we have no interest in keeping the money of someone who is not happy with it.
Since the paid plans are reserved for professionals (article 2), we are not a member of a consumer mediation scheme. If you did nevertheless contract as a consumer, you keep in full the rights the law gives you on that basis, and our refund commitment above applies first.
15. Applicable law
These terms are governed by French law. In the event of a dispute, the French courts have jurisdiction. If you are a consumer, you keep the right to bring proceedings before the courts of your place of residence.
16. Changes to these terms
These terms may change. The terms applicable to your subscription are those accepted when you subscribed. Any substantial change is notified to you by email at least thirty days before it takes effect, and you can cancel free of charge if it does not suit you.
